These terms set out the basis on which Egyptian Marble & Limestone supplies natural stone to buyers worldwide, and the rules that apply when you use this website.
1. Agreement to These Terms
These Terms & Conditions govern your use of the website of Egyptian Marble & Limestone ("EML", "we", "us" or "our") and any quotation, order or supply of goods and services made through it. By browsing this website, requesting a quotation or placing an order, you confirm that you accept these terms and that you have authority to bind the company you represent.
If you do not accept these terms, please do not use the website or place an order with us.
2. Definitions
- Goods — the marble, granite, limestone, travertine, onyx, quartz, mosaic and related stone products supplied by EML.
- Buyer — the person or company placing an order for Goods.
- Order — a purchase confirmed in writing by both parties, whether by signed proforma invoice, sales contract or email confirmation.
- Website — this website and all its pages, content and images.
3. Use of the Website
You may use this website for lawful purposes connected with evaluating and purchasing our Goods. You agree not to:
- Copy, scrape or republish our content, images or product data for commercial use without our written permission.
- Attempt to gain unauthorised access to the website, its servers or any connected system.
- Introduce viruses or any other material that is malicious or technologically harmful.
- Use the website in any way that breaches applicable law or infringes the rights of others.
We may suspend or withdraw access to the website, in whole or in part, without notice.
4. Natural Stone Variation
All Goods supplied by EML are natural products extracted from quarries. Colour, veining, shade, pattern, crystalline structure and the presence of natural marks such as fissures, pits and colour concentrations vary from block to block, from batch to batch and even within a single slab. These characteristics are inherent to natural stone and are not defects.
Images, samples and photographs on this website are indicative only and are intended to show the general character of a material. They cannot be treated as an exact representation of the material delivered. For critical projects we recommend approving a control sample or viewing the actual blocks or slabs before production.
5. Quotations, Orders & Prices
Quotations are valid for the period stated on the quotation and, unless otherwise agreed, for thirty (30) days from issue. A quotation is an invitation to order and does not constitute a binding contract until we confirm the Order in writing.
Prices are quoted in the currency and on the delivery terms shown on the quotation, and are exclusive of taxes, duties and any charges levied in the destination country unless expressly stated. We reserve the right to adjust prices before Order confirmation to reflect changes in raw material cost, quarry availability, freight rates or exchange rates.
Once an Order is confirmed and production has started, cancellations or specification changes may not be possible, and any costs already incurred remain payable by the Buyer.
6. Payment Terms
Unless otherwise agreed in writing, payment terms are stated on the proforma invoice and typically require an advance deposit before production, with the balance settled prior to shipment or against shipping documents.
- All bank charges outside Egypt are borne by the Buyer.
- Goods remain the property of EML until payment has been received in full.
- Late payment may result in suspension of production or shipment, and may attract interest at the rate permitted by applicable law.
7. Shipping, Delivery & Risk
Delivery terms are agreed per Order and interpreted in accordance with the Incoterms rules current at the date of the Order (for example FOB, CFR or CIF). Risk in the Goods passes to the Buyer in accordance with the agreed Incoterm.
Delivery and production dates are estimates given in good faith. They depend on quarry supply, weather, vessel schedules and port operations, and are not guaranteed. EML is not liable for delays caused by carriers, customs authorities, inspection agencies or any circumstances outside our reasonable control.
Quantities may vary slightly from those ordered due to the nature of block cutting and packing. Unless otherwise agreed, a variation of up to five percent (5%) in quantity is acceptable and is invoiced on the quantity actually shipped.
8. Inspection & Claims
The Buyer or its appointed agent is welcome to inspect the Goods before shipment. Where the Buyer chooses not to inspect, the Goods are deemed accepted as loaded.
Any claim relating to quantity, visible damage or non-conformity must be notified to us in writing within fifteen (15) days of the Goods arriving at the destination port, together with photographs and supporting documentation. Claims submitted after that period, or relating to Goods that have already been cut, processed or installed, cannot be accepted.
Where a claim is accepted, our liability is limited, at our option, to replacing the affected material or issuing a credit for its invoiced value.
9. Intellectual Property
All content on this website — including text, product descriptions, photographs, project images, logos and the EML name — is owned by or licensed to EML and is protected by copyright and trade mark law. You may view and print pages for your own internal business use, but you may not reproduce, distribute or commercially exploit any part of it without our prior written consent.
10. Your Submissions
When you send us drawings, specifications, project details or other material, you confirm that you have the right to share it and you grant us permission to use it for the purpose of preparing quotations and producing your Order. We treat commercially sensitive material as confidential. Please see our Privacy Policy for how we handle personal data.
11. Third-Party Links
This website may contain links to third-party websites and services. Those links are provided for convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss arising from your use of them.
12. Disclaimers & Limitation of Liability
The website and its content are provided on an "as is" basis. While we take care to keep product information, technical data and availability accurate, we do not warrant that the website is free of errors or that the information on it is complete or current at all times.
Technical values such as density, water absorption, compressive strength and flexural strength are indicative averages obtained from testing representative samples. They should be verified against a project-specific test report where the application requires it.
To the fullest extent permitted by law, EML is not liable for indirect or consequential loss, including loss of profit, loss of contract, delay costs or installation costs. Our total liability arising out of any Order is limited to the invoiced value of the Goods giving rise to the claim. Nothing in these terms excludes liability that cannot lawfully be excluded.
13. Indemnity
You agree to indemnify EML against any claim, loss or expense arising from your breach of these terms, from your misuse of the website, or from any material you supply to us that infringes the rights of a third party.
14. Force Majeure
EML is not responsible for any failure or delay in performing its obligations where that failure or delay results from events beyond our reasonable control — including quarry closure, extreme weather, fire, flood, strike, epidemic, war, civil unrest, port congestion, vessel delay, changes in export regulation or acts of government.
15. Governing Law & Jurisdiction
These Terms & Conditions and any Order made under them are governed by the laws of the Arab Republic of Egypt. The parties will first attempt to resolve any dispute amicably. Failing that, the competent courts of Cairo, Egypt shall have jurisdiction, unless the parties have agreed in writing to submit the dispute to arbitration.
16. Changes to These Terms
We may revise these Terms & Conditions at any time by updating this page. The version published at the time you place an Order is the version that applies to that Order. Please check this page periodically so you are aware of any changes.
